Over the past twenty-five years, thirty-seven states and the US Congress have passed mental health and substance use disorder (MH/SUD) parity laws to secure nondiscriminatory insurance coverage for MH/SUD services in the private health insurance market and through certain public insurance programs. However, in the intervening years, litigation has been brought by numerous parties alleging violations of insurance parity. We examine the critical issues underlying these legal challenges as a framework for understanding the areas in which parity enforcement is lacking, (...) as well as ongoing areas of ambiguity in the interpretation of these laws. We identified all private litigation involving federal and state parity laws and extracted themes from a final sample of thirty-seven lawsuits. The primary substantive topics at issue include the scope of services guaranteed by parity laws, coverage of certain habilitative therapies such as applied behavioral analysis for autism spectrum disorders, credentialing standards for MH/SUD providers, determinations regarding the medical necessity of MH/SUD services, and the application of nonquantitative treatment limitations under the 2008 federal parity law. Ongoing efforts to achieve nondiscriminatory insurance coverage for MH/SUDs should attend to the major issues subject to private legal action as important areas for facilitating and monitoring insurer compliance. Abstract:When confronted with moral dilemmas, Charles S. Peirce would recommend that we trust our sentiments, not our reasoning. A scientific exploration of ethics may affect our daily conduct but should only do so gradually. Some modern approaches take the opposite stance and deny the significance of moral sentiments. Considering both Peirce and his opponents, I aim to contribute to the discussion of a radical moral theory: effective altruism. Stating that we should strive to do the most objective good we can, (...) effective altruism regularly conflicts with our moral sentiments. In response, effective altruists claim that our sentiments are misguided and should be overcome. Which side is right? Using Peirce's work to answer this question reveals that effective altruism cannot clearly define how it aims to affect our daily conduct. In addition, it seeks to change our sentiments, but may alter them for the worse. Taking Peirce's insights seriously leads us to conclude that we should be cautious of how we adopt effective altruism in our lives—and that while we deliberate this, we should instead trust our sentiments. Nous mettons en évidence que si, dans une construction interrogative portant sur un complément prépositionnel, C est spécifié par un constituant interrogatif, alors C ne porte pas de P préfixée. Si C est spécifié par un constituant non interrogatif ou bien si (...) le spécificateur de C n’est pas réalisé morphologiquement, alors C est préfixé par P. As a strategy for exploring the relationship between understanding and knowledge, we consider whether epistemic luck – which is typically thought to undermine knowledge – undermines understanding. Questions about the etiology of understanding have also been at the heart of recent theoretical debates within epistemology. Kvanvig (2003) put forward the argument that there could be lucky understanding and produced an example that he deemed persuasive. Grimm (2006) responded with a case that, he argued, demonstrated that there could not be lucky (...) understanding. In this paper, we empirically examine how participants' patterns of understanding attributions line up with the predictions of Kvanvig and Grimm. We argue that the data challenge Kvanvig's position. People do not differentiate between knowing-why and understanding-why on the basis of proper etiology: attributions of knowledge and understanding involve comparable (and minimal) roles for epistemic luck. We thus posit that folk knowledge and understanding are etiologically symmetrical. (shrink)

Morals of 13th-20th century Mongolian Moral Doctrines.

Concepts stand at the centre of human cognition. We use concepts in categorizing objects and events in the world, in reasoning and action, and in social interaction. It is therefore not surprising that the study of concepts constitutes a central area of research in philosophy and psychology, yet only recently have the two disciplines developed greater interaction. Recent experiments in psychology that test the role of concepts in categorizing and reasoning have found a great deal of variation, across individuals and (...) cultures, in categorization behaviour. Meanwhile, philosophers of language and mind have investigated the semantic properties of concepts, and how concepts are related to linguistic meaning and linguistic communication. A key motivation behind this was the idea that concepts must be shared across individuals and cultures. With the dawn of experimental philosophy, the proposal that the experimental data from psychology lacks relevance to semantics is increasingly difficult to defend. -/- This volume brings together leading psychologists and philosophers to advance the interdisciplinary debate on the role of concepts in categorizing and reasoning, the relationship between concepts and linguistic meaning and communication, the challenges conceptual variation poses to communication, and the social and political effects of conceptual change.
